Welcome to SSTW Store. The terms “we,” “us,” and “our” refer to SSTW Store. SSTW Store operates this website and online store, including all related information, content, features, tools, products, and services offered to provide customers with a curated shopping experience (collectively, the “Services”).

Our store is powered by Shopify, which enables us to provide the Services to you.

Minor differences in placement, color, scale, or appearance may occur between product images and the item received and do not necessarily constitute a defect.

Product descriptions, pricing, availability, and specifications may be updated without notice. We reserve the right to discontinue a product or limit the quantity available to any person, household, geographic region, or jurisdiction, subject to applicable law.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase products from SSTW Store.

We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including in cases of suspected fraud, unauthorized activity, pricing errors, inventory problems, production limitations, or violations of these Terms.

An order is not accepted until payment has been successfully processed and we send confirmation that the order has been accepted.

Please review your order carefully before submitting it. Because some products may enter production shortly after an order is placed, cancellation or modification requests cannot always be accommodated.

If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number provided with the order. If we cancel an order after payment has been collected, we will issue an appropriate refund.

You represent that products purchased through the Services are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 — PRICES, PROMOTIONS, AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed, as confirmed in your order confirmation.

Unless expressly stated otherwise, listed prices do not include shipping, handling, taxes, duties, customs fees, or import charges.

Promotions may be governed by separate conditions. If promotional terms conflict with these Terms, the specific promotional terms will apply to that promotion.

Discount codes cannot be combined unless expressly stated. We reserve the right to modify, suspend, or cancel a promotion where permitted by law, but changes will not retroactively affect properly completed orders.

You agree to provide accurate, current, and complete purchase, payment, billing, and account information.

Processing and delivery times are estimates unless expressly stated otherwise.

Delivery may be affected by carrier delays, severe weather, customs processing, incorrect addresses, high order volume, supply interruptions, or other circumstances outside our reasonable control.

We will make reasonable efforts to fulfill orders within the stated timeframe and will provide notices, cancellation options, or refunds when required by applicable law.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and the content provided through them—including trademarks, brand names, logos, characters, artwork, text, photographs, illustrations, graphics, videos, audio, product designs, slogans, website layout, and other materials—are owned by or licensed to SSTW Store and are protected by applicable United States and international intellectual property laws.

This includes, without limitation, the Stop Shooting the Watermelons name, its characters, artwork, visual identity, logos, slogans, product designs, and related creative materials.

You may access and use the Services only for personal, non-commercial purposes.

Without our prior written permission, you may not reproduce, copy, modify, distribute, publish, publicly display, sell, license, create derivative works from, download, store, scrape, or commercially exploit any protected portion of the Services.

Nothing in these Terms grants you any license or ownership rights in the intellectual property of SSTW Store, Shopify, or any third party except for the limited right to use the Services in accordance with these Terms.

All rights not expressly granted are reserved.

SSTW Store is powered by Shopify, which enables us to provide the Services.

However, purchases made through our store are transactions directly between you and SSTW Store.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from SSTW Store and is not responsible for any aspect of the transaction between you and SSTW Store, including injury, damage, or loss resulting from purchased products or services.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from purchases and transactions made with SSTW Store.

If we cancel an order because of an error after payment has been collected, we will issue an appropriate refund.

Not bypass CAPTCHAs or other measures intended to distinguish automated activity from human activity.

We may suspend or terminate your account or access to the Services if you violate these Terms, engage in fraud or abuse, threaten the security or operation of the Services, or where otherwise permitted by applicable law.

You remain responsible for amounts properly due before termination.

Sections that by their nature should survive termination will remain effective, including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy.

SECTION 16 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

Except as expressly stated by SSTW Store, we do not guarantee that the Services will always be uninterrupted, secure, timely, or error-free.

To the fullest extent permitted by applicable law, SSTW Store disclaims implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

Some jurisdictions do not allow certain exclusions or limitations of implied warranties. In those jurisdictions, these disclaimers apply only to the extent permitted by law.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded or limited.

To the fullest extent permitted by applicable law, SSTW Store and its owners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from the use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, willful misconduct, gross negligence where it cannot be limited, or other non-waivable consumer rights.

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SSTW Store, Shopify, and our respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal fees arising from:

Your infringement of another person’s rights.
Your unauthorized or unlawful use of the Services.

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate reasonably in the defense of such a claim.

This section does not require a consumer to indemnify any party for that party’s own unlawful conduct, negligence, or breach of these Terms.

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or severed to the minimum extent necessary.

The remaining provisions will remain valid and enforceable.

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms and the policies referenced herein constitute the entire agreement between you and SSTW Store concerning your use of the Services and supersede prior communications or agreements concerning the same subject.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, change of control, or transfer of the business, subject to applicable law.

SECTION 22 — GOVERNING LAW

These Terms and any separate agreements through which we provide the Services will be governed by the laws of the State of Louisiana and applicable federal laws of the United States, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights or jurisdictional protections that cannot be waived, disputes relating to these Terms or the Services will be brought in the state or federal courts having jurisdiction in Orleans Parish, Louisiana.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived under the laws applicable to that consumer.

Section headings are provided for convenience and do not limit or affect the interpretation of these Terms.

SECTION 24 — CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page.

We may update these Terms by publishing a revised version on the website. When required by applicable law, we will provide notice of material changes.

The updated Terms will take effect on the date stated in the revised version. Changes will not retroactively alter the terms governing a completed purchase unless permitted or required by law.
